NOTIFICATION OBLIGATION WHEN POSTING TO THE NETHERLANDS: as from 1 September you will actually be fined!

As previously announced in our article of 5 February 2020, as of 1 March 2020 there is a notification obligation when posting to the Netherlands. Employers from the European Economic Area or Switzerland are obliged to give prior notification of their arrival and that of their employees.

Self-employed persons in certain sectors are also required to report their work in advance, as are temporary employment agencies that post temporary employees to the Netherlands. Furthermore, special rules apply to the transport sector.

The notification must be submitted prior to the commencement of the work via the online notification portal electronic reporting platform. The Dutch government has published a checklist for foreign employers containing the information required to complete a notification (checklist for foreign employer).

So what has changed now? During a transitional period up until 31 August 2020, no punitive action was taken against possible violations. However, as from 1 September 2020, violations will actually be sanctioned.

In addition to this notification obligation, there are a number of other obligations that must be complied with when working in the Netherlands. We therefore recommend that you always have your project screened prior to your work.
