New obligations from 1 January 2026: Update – Due diligence reporting desk now available

On 1 January 2026, the new due diligence obligation came into force in Flanders for certain high-risk sectors (construction, cleaning, meat sector and delivery services). As explained in our previous publications, companies must proactively verify that their direct (sub)contractors do not employ third-country nationals illegally residing in Belgium, and they must report missing or clearly invalid/forged documents to the social inspectorate. 

Reporting desk now operational 

The digital reporting desk of the Flemish Social Inspectorate is now in use. You can report missing, clearly forged or invalid documents here, so that you comply with your due diligence obligation and eliminate the risk of chain liability. 

Important to know: 

  • Identification via NSSO: To make a digital declaration in the name of your company, your company must be registered with the NSSO. Any company with a Belgian CBE number can register with the NSSO. We can support you in this.  
  • Companies without a Belgian CBE number cannot use the desk and must request a PDF form via ketenaansprakelijkheid.wewis@vlaanderen.be. We can of course always assist you with the request of this form.  
  • It is currently not possible to have a social service provider make a report on behalf of your company via the reporting desk.

Action points: 

  • Check whether your company is already registered with social security (if you have a CBE number in Belgium). 
  • Use the reporting desk or, if applicable, the PDF form to fulfil your reporting obligation.
