From Limburg to the US: how Hammer-IMS successfully handled its first secondment

What was your challenge when seconding staff to the US?

This was a first for us: it was the very first time we had seconded anyone from Hammer-IMS. Our employee was going to spend a year and a half at our American branch, which raised a lot of questions.

We had no experience with the regulations surrounding such international employment and we wanted to be sure that everything was arranged correctly – in accordance with both Belgian and American legislation. This involved social security, labour law, taxation and payroll. At the same time, we wanted to ensure that our employee did not suffer any personal disadvantages, but retained an equivalent salary package.

What role did Van Havermaet play in the solution?

Van Havermaet guided us step by step through this complex process. They helped draft the employment law documents – in consultation with our American law firm – and ensured that the payroll ran smoothly on both sides of the Atlantic.

Because Van Havermaet is part of an international network of consultancy firms, they were able to put us in touch with their American partner immediately. A shadow payroll was set up in the US, while in Belgium the exemption of US income was correctly processed in the personal income tax. The reporting obligations and tax returns for non-residents in the US were also followed up and coordinated in this way.

What made the collaboration so valuable for you?

What immediately struck us was that Van Havermaet acted as the first point of contact. Secondment involves multiple parties – from payroll specialists to lawyers – but we never had to figure out who was responsible for what. Van Havermaet took the lead every time, remained in control and ensured that everything was perfectly coordinated, especially with regard to the Belgian and American payroll.

That gave us a lot of confidence and saved us a lot of worry. The feeling that there is someone who keeps an overview and manages the right partners makes a big difference.
